Seller Terms & Submission Agreement
These Terms apply when you submit cards to Hit Exchange for evaluation and potential purchase. They cover valuation, offers, shipping, optional shipping protection, delivery, verification, and payment.

These Seller Terms & Submission Agreement ("Terms") apply when you submit cards or other collectibles to MBLG Sports Cards, LLC d/b/a Hit Exchange ("Hit Exchange," "we," "us," or "our") for evaluation and potential purchase. They cover the full lifecycle of your submission — valuation, offers, communication, shipping, optional shipping protection, delivery, verification, and payment. Please read them before you submit.
1. Eligibility and Authority to Sell
By submitting items to Hit Exchange, you represent and warrant that:
- You are legally authorized to sell the items you submit.
- You own the items, or you have full authority from the owner to sell them.
- To the best of your knowledge, the items are authentic and are not stolen, counterfeit, altered, fraudulently obtained, or subject to any lien, dispute, or third-party claim.
- The information you provide about yourself and the items is accurate to the best of your knowledge.
Hit Exchange may decline, suspend, or cancel a transaction if concerns arise regarding ownership, authenticity, fraud, identity, or other eligibility matters.
You also represent that you are at least 18 years old (or the age of majority where you live, if that age is higher) and have the legal capacity to enter into and be bound by these Terms. If you are submitting on behalf of another person or an entity, you represent that you are authorized both to sell the items and to bind that person or entity to these Terms. Hit Exchange does not knowingly transact with minors, and it may request reasonable verification of age, identity, or authority before completing a transaction.
2. Submitting Cards Does Not Guarantee an Offer
Submitting cards is a request for evaluation and does not obligate Hit Exchange to purchase anything. Hit Exchange may, in its sole discretion:
- Make an offer on some, all, or none of your cards;
- Decline a submission in whole or in part;
- Request additional photos or information; or
- Revise an offer before you accept it if new information materially affects valuation or eligibility.
Hit Exchange is not required to provide a reason for declining a submission.
3. How Hit Exchange Values Cards
Offers may take into account a range of factors, which can include recent comparable sales, current market pricing, player or athlete trends, scarcity and liquidity, grade and grading company, condition and eye appeal, set, parallel, serial numbering, autograph or memorabilia attributes, collector and buyer demand, market volatility, current inventory needs, and other market information.
Comparable sales are a reference point and do not guarantee a specific value, and values can change rapidly. Hit Exchange does not guarantee that its offer is the highest possible, future, replacement, auction, or retail value. You are always free to accept or decline an offer.
4. Offers and Acceptance
An offer is not a completed sale until you affirmatively accept it through the Hit Exchange quote and portal experience. Where supported, you may accept or decline cards individually, and only the cards you specifically accept become part of the proposed transaction.
Offers may expire. If an offer expires before you accept it, Hit Exchange may revalue the cards before issuing another offer. After you accept and ship, the transaction proceeds subject to physical receipt, verification, authenticity, condition, and confirmation that the cards received match the accepted offer.
5. Physical Verification
All offers are based on the information available before physical receipt. After your cards are delivered, Hit Exchange may verify card identity, certification number, grade, authenticity, condition, any alterations or damage, whether the item matches the submitted photos and description, and whether all expected items arrived.
If a card materially differs from what was submitted or accepted — for example a wrong card, wrong certification number, wrong grade, undisclosed damage, an authenticity concern, or an alteration — Hit Exchange may place payment for that item on hold and contact you to resolve it. This protects against genuine discrepancies. It is not a right to arbitrarily reprice a correctly represented card after acceptance.
6. Shipping Options and Shipping Cost
After you accept an offer, eligible sellers may be offered the ability to purchase a shipping label through the portal, and Hit Exchange may facilitate access to services through third-party shipping providers. Unless Hit Exchange states otherwise, shipping costs are your responsibility, and a label purchased through the portal is deducted from your final payout. You will see the shipping cost and the resulting estimated final payout before you buy a label.
Available carriers, services, speeds, and requirements may vary based on package value, destination, carrier availability, protection requirements, security, and other operational needs. Hit Exchange may restrict shipping methods for higher-value shipments.
7. Responsibility for Cards During Shipping
Unless otherwise required by law, you remain responsible for the cards and bear the risk of loss, theft, damage, misdelivery, or other loss until the package is physically delivered to and received by Hit Exchange at the designated location.
The fact that Hit Exchange generates or facilitates a label, provides discounted rates, provides tracking, recommends a carrier, or facilitates optional third-party shipping protection does not mean it takes possession of your cards before delivery or assumes the risk of loss in transit. The carrier is an independent third party, and a provided or facilitated label is a convenience — it does not make Hit Exchange the carrier or the insurer.
You are responsible for:
- Properly and securely packaging your cards;
- Accurately declaring package information;
- Following the shipping instructions provided;
- Using the correct label and tendering the package to the designated carrier;
- Obtaining and retaining proof of carrier acceptance; and
- Following applicable carrier and protection-provider requirements.
8. Optional Shipping Protection
Where available, sellers may be offered optional third-party shipping protection when purchasing a label, currently provided by XCover (via Shippo) (or another identified provider). Hit Exchange is not the insurer, underwriter, or claims administrator, and is not the party that determines eligibility or approves or denies claims.
Coverage is subject to the provider's terms, policy wording, eligibility, exclusions, limits, deductibles (if any), packaging and documentation requirements, claim deadlines, and final determination. Purchasing protection does not guarantee that a claim will be approved or paid. The cost of protection is your responsibility and, when purchased through the shipping flow, is disclosed before purchase and deducted from your final payout. The provider's official terms control over any summary shown by Hit Exchange.
9. Documenting and Packaging Shipments
You are responsible for packaging your cards securely enough to withstand normal shipping and handling. Before shipping, we strongly recommend that you retain:
- Clear photos of the cards and their condition;
- Photos or video of the packing process and protective packaging;
- Photos of the sealed package and a clear image of the label attached to it;
- The carrier acceptance or drop-off receipt and tracking information.
For higher-value shipments, we recommend a continuous video showing the cards, their condition, the packing process, sealing, and the completed label. We distinguish steps that are REQUIRED by the carrier or protection provider from documentation practices that are RECOMMENDED. Photos or video do not guarantee that a claim will be approved.
10. Lost, Stolen, or Damaged Shipments
If a shipment is lost, stolen, damaged, misdelivered, or otherwise does not reach Hit Exchange as expected, please notify us promptly. Hit Exchange may assist with available shipment information and with the applicable claims process.
However, Hit Exchange does not guarantee recovery of a package or payment of any insurance or protection claim; claims are subject to the carrier's or third-party provider's rules and decisions. You agree to reasonably cooperate with documentation and claim requirements.
11. Payment When a Shipping Claim Exists
Hit Exchange's normal payment obligation applies to cards that are physically received and successfully verified. If cards are lost, stolen, damaged, or otherwise subject to a shipping or protection claim before being received and verified, Hit Exchange is not required to pay the original accepted amount while the claim is unresolved.
No payment for the lost or damaged property is due unless and until (a) Hit Exchange actually receives and verifies the applicable cards, or (b) an applicable insurance or protection claim is approved and the funds are actually received or otherwise made available under the claim arrangement. Any claim-based payment is subject to the amount actually approved and paid by the provider, coverage limits, deductibles, exclusions, shipping and protection costs, and other applicable adjustments. Hit Exchange is not required to advance insurance proceeds before they are actually received or confirmed payable.
12. Delivery and Payment Timing
Payment is generally sent within 24 hours after (1) the package has been delivered to Hit Exchange, and (2) the cards have been received and successfully verified. The payment clock is tied to delivery and verification — not to acceptance or shipping.
Payment may take longer when reasonably necessary due to card discrepancies, authenticity concerns, missing cards, damaged shipments, fraud or identity concerns, payment-information issues, compliance review, shipping claims, or circumstances outside Hit Exchange's reasonable control. Once payment is initiated, the actual availability of funds may depend on your payment method, bank, card network, or other provider.
13. Payment Method and Fees
Available payment methods will be shown when applicable, and options, processing times, limits, and availability may vary. Any seller-paid fee for an optional payment method will be clearly disclosed before you select or confirm it. Hit Exchange may use third-party payment providers to process payouts, and you are responsible for providing accurate payout information.
14. Communication Consent
By submitting your contact information and starting a submission, you agree that Hit Exchange may contact you about your submission, valuation questions, your quote or offer, shipping, tracking, delivery, verification, payment, customer service, and transaction-related follow-up, by email, SMS or text message, or phone, using the contact information you provided.
This is transactional communication about your submission and is separate from marketing consent — accepting these Terms does not enroll you in promotional marketing SMS or email. Message and data rates may apply for SMS. You can opt out of non-essential texts by replying STOP or as otherwise instructed.
15. Privacy and Third-Party Service Providers
Hit Exchange may use third-party providers to operate parts of the submission and transaction process, including website and portal infrastructure, data storage, email, SMS, shipping, tracking, shipping protection, and payment processing.
Personal information is handled in accordance with the Hit Exchange Privacy Policy.
16. Fraud, Abuse, and Suspicious Activity
Hit Exchange may pause, decline, cancel, or investigate a transaction where there is reasonable concern involving fraud, stolen property, counterfeit or altered cards, misrepresentation, identity concerns, payment abuse, shipping abuse, manipulation of the submission or quote system, or other unlawful or suspicious activity. Hit Exchange may cooperate with carriers, insurers or protection providers, payment providers, law enforcement, and other appropriate parties when reasonably necessary.
17. Electronic Transactions
You agree to conduct the submission, quote, acceptance, shipping, and payment process electronically. Electronic acceptance, checkbox consent, timestamps, quote decisions, and other electronic records may be used as evidence of the transaction.
18. Changes to These Terms
The Terms applicable to a submission are the version accepted when that submission is created, unless you affirmatively agree to updated terms where required. Hit Exchange may update these Terms for future submissions.
19. Legal Terms
Governing Law and Venue. These Terms, and any dispute arising out of or relating to these Terms or your submission, are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles, together with applicable United States federal law. Subject to the dispute resolution provisions below, any permitted court action must be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction and venue of those courts.
Dispute Resolution and Arbitration. Please read this section carefully, as it affects how disputes are resolved. You and Hit Exchange will first try to resolve any dispute informally by contacting each other and negotiating in good faith for at least 30 days. If the dispute is not resolved, you and Hit Exchange agree that it will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, rather than in court — except that either party may bring an individual claim in small-claims court, or seek injunctive or equitable relief in court to protect its intellectual property or confidential information.
To the maximum extent permitted by law, you and Hit Exchange each waive any right to a jury trial and any right to bring or participate in a class, collective, consolidated, or representative action. You may opt out of this arbitration agreement by emailing support@hit-exchange.com within 30 days after you first accept these Terms; opting out will not affect any other part of these Terms. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court, but the remainder of this section will remain in effect.
Limitation of Liability. To the maximum extent permitted by law, Hit Exchange and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or lost business opportunities, arising out of or relating to your submission or these Terms, even if advised of the possibility of such damages. To the maximum extent permitted by law, the total aggregate liability of Hit Exchange arising out of or relating to a submission will not exceed the greater of (a) the accepted offer amount for the specific cards giving rise to the claim, or (b) the amount actually recovered for those cards under an applicable carrier or shipping-protection claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you, and nothing in these Terms limits liability that cannot be limited under applicable law.
Disclaimer of Warranties. Except as expressly stated or required by law, the Hit Exchange website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement. These Terms, together with any documents they reference, make up the agreement between you and Hit Exchange regarding your submission, and supersede prior understandings on that subject.
